Job Description Summary:
This is a part time, fixed term position for 12 months.
Licensing Manager - Grade 12 – Pro Rata Salary £23,057 - £24,717
ROLE AND PURPOSE
To manage the work of the Licensing Section, support the Licensing Committee to develop and implement licensing policies and thereby enable the Council to function effectively as a Licensing Authority for a range of licensable activities. Primarily these include taxis, namely Private Hire and Hackney Carriage drivers, vehicles and operators, premises licensed for gambling in accordance with the Gambling Act 2005 and those licensed for the sale of liquor and/or provision of regulated entertainment in accordance with the Licensing Act 2003.
To act as a senior member of the Public Protection Division management team and contribute to the development and delivery of the Service Area Business Plan; with specific responsibility for the actions of staff within the Licensing Section. This requires implementing corporate policies and procedures, and being conversant with national policies and initiatives involving licensing.
To develop an annual work plan for the Licensing Section, identify priorities, set targets and monitor performance to ensure that the licensing function is managed effectively and delivered within budget.
To take the lead role in ensuring operational procedures are developed and reviewed, ensuring officers are competent to exercise their statutory powers, that resources are allocated on the basis of risk and that any enforcement action is consistent with the requirements of the Councils Licensing Policies, legislation and Government guidance as appropriate.
PRINCIPAL ACCOUNTABILITIES:
1 Strategy - To be conversant with national strategies and initiatives for key areas within the scope of the job, to create and implement policies, operating procedures, and work programmes which are consistent with these and overarching corporate aims and objectives. To produce and manage the delivery of an annual work plan for the Licensing Section having regard to best value ensuring performance targets are met and that statutory services are provided in accordance with the relevant legislation and guidance including that issued by the Home Office and Department for Transport.
2 Customer Focus - To lead the Section forward, on quality, performance and promote a customer focused culture to ensure that services are delivered effectively and in response to identified need.To ensure the Section paticipates fully in consulting service users to identify their expectations, to receive feedback on the quaility of the service provided, and to benchmark performance. To act on this information and enable the Section to meet its targets for customer satisfaction and to strive for continuous improvement.
3 Performance Management - To work as part of the Public Protection management team, effectively manage the performance of the Section, and be able to demonstrate achievements and outcomes in measurable terms against the Service Area Business Plan.To monitor and evaluate service delivery against individual and team targets, take corrective action to address underperformance, ensure the production of timely and accurate performance reports, maintain quality standards, benchmark performance ,and achieve continuous improvement in service delivery.
4 Leadership – To lead by example, and create a positive culture within the Section. To motivate, develop and support staff to achieve their full potential through the application of an effective approach to managing personal performance and development.To ensure that the performance of staff and their continued professional development is regularly reviewed and is commensurate with their duties and the powers that they are authorised to exercise on behalf of the Council. To provide staff with guidance and direction when dealing with complex licensing issues.
5 Statutory Obligations – To act as the lead officer for the Council with responsibility for managing the administration of the licensing function and the enforcement of the relevant statutory provisions and licence conditions.To ensure that the Council develops, adopts and implements Policies that enable it to function as a Licensing Authority in respect of the full range of licensing duties including those under Taxi Licensing, the Licensing Act 2003 and the Gambling Act 2005
6 Budget Operation –To be responsible for operating the Section’s budget and all other financial functions.To report and be accountable for performance to the Head of Public Protection, ensuring that income targets are met and expenditure targets are not exceeded, working to mitigate any variances and ensuring that procurement and all other Council financial requirements are adhered to.
7 Enforcement –To act as “The Officer in Charge” for all criminal investigations undertaken by officers of the Section, and ensure that they exercise their statutory powers in accordance with relevant legislation and guidance including the Police and Criminal Evidence Act 1984, the Criminal Procedures and Investigations Act 1996, the latest Code for Crown Prosecutors as well as the Councils Enforcement Policy. To ensure that officers exercise their other powers correctly, and in accordance with their authorisations.To represent the Licensing Authority (Council) in relevant court procedings.
8 Working With Partners –To develop and maintain effective working partnerships with other Council departments, central government departments, and other statutory bodies, such as the Police, and Humberside Fire and Rescue to ensure that there are good communications and to maximise the potential benefits of collaborative working.To manage the Responsible Authorities Group for the purposes of ensuring a coordinated and risk based approach for enforcing the provisons of the Licensing Act 2003
9 Advice and Support -To ensure the provision of good quality advice and information on best practice and the law in all areas of operation to assist members, businesses, employees, voluntary agencies, the public and other Council staff understand their legal responsibilities and to help build legal compliance .To plan and partcipate in local and national campaigns, initiaves or surveys aimed at delivering improvements to the licensing service, raising standards and sharing good practice to enhance the profile of the Council or City generally.
10 Licensing Committee -To draft and present reports, and to recommend strategies, policies and work programmes for consideration by senior managers and members of the Councils Licensing Committee and Sub Committees.
